Conditions the following definitions apply:
“The Agreement” is
your Booking Confirmation and the Terms and Conditions;
“The Organisation” is The Foggy Dog Hotel Ltd
“The Hotel” is the premises for which your Booking is made;
“The Booking(s)” includes accommodation, functions and any event bookings made;
“The Guest(s)” is the person, organisation, organisation or other body
responsible for making the Booking
Bookings & Payments
All bookings are subject to availability and The Heritage Park Hotel reserve
the right to refuse any booking at its sole discretion.
All bookings require a credit/debit card to guarantee the reservation.
Certain offers and rates require full payment at time of booking which
is non-refundable and non-transferable.
All reservations require guests to fully pay for the accommodation
package on arrival at the hotel with the exception of (4) above which is
All rates quoted are per person for the duration of your stay.
All rates include UK VAT at the current rate and any local taxes.
On check in, the front desk will verify your check out date. Rates
quoted are based on the check in date and length of stay you specified. Should
you choose to depart early the daily rate for the nights you have stayed may be
altered and charged at full published rate. If you are on a package the full
amount the stay will be charged and there will be no refund for the portion you
have not taken up.
The Foggy Dog Hotel T/A Heritage Park Hotel reserve the right to cancel
or modify reservations where it appears that a customer has engaged in
inappropriate activity to gain a preferential rate.
Additional services purchased during your stay may be charged to your room
account and paid on departure, only if you have pre-authorised a credit card
with reception on check-in. If a card is not pre-authorised, any additional
services are required to be paid by cash at point of purchase.

Change of Booking
Reservations may be altered in line with the booking terms &
conditions agreed on the original reservation.

Any changes to arrival and departure dates may result in rate changes
that could be higher than the original rates quoted.
Check in time is from 3pm on the day of arrival
Check out time is by 10am on the day of departure
Later check out may be arranged direct with the hotel, subject to availability
and will be subject to an additional charge.
Contagious Medical Conditions
If The Foggy Dog Hotel T/A Heritage Park Hotel
believe that there is a situation which requires us to protect the health of
other guests and staff, we will cancel a booking if you or any member of your
party has or just had an infectious or contagious medical condition. During a
holiday, we will ask any, or all of you to refrain from participating in
certain activities, ask you to leave public areas, or ask you to remain in your
guest rooms should we in our sole discretion consider it necessary. You should
inform us immediately should any such condition develop within four (4) weeks
of your arrival or whilst you are on holiday with us.
Booked Guests staying may use the Fitness facility throughout the
duration of their stay subject to the opening hours of that facility. Please
contact the Hotel for details of their opening hours. A condition of using the
facilities is that you must comply with the Hotel’s rules.
Children less than
16 years of age must be accompanied by an adult at all times and may use the
facilities until 9.00 p.m. For health and safety reasons children under 16 are
not permitted to use gym equipment.
At certain times,
facilities may become unavailable due to maintenance, adverse weather
conditions or other reasons beyond our control. We will attempt to keep all
hotel guests informed of these circumstances however this may not always be possible.
If any facility is a significant reason for your choice of hotel, we would
advise you to check directly with the hotel in advance of arrival.
We have a hotel car park, there may be limited spaces available, parking is
complimentary and Theft, loss or damage is totally at your own risk.
Please be aware that at certain times throughout the year some of our hotels
may host weddings, events and parties, which you may feel would be an intrusion
on your stay.
The Organisation’s liability where accommodation is booked for Guest belongings
is generally limited under the Hotel Proprietors Act 1956.

In the unlikely event that you have a problem during your stay you must bring
it to the attention of the hotel management at the time to ensure that we have an
opportunity to rectify the problem during your stay.
The Organisation, Hotel, functions and conferences within it are subject to
Statutory Regulations including those relating to fire precautions and
entertainment. The regulations must be strictly observed and a copy is available
from the Hotel. The provisions of the Licensing Act 1964 as amended must

The Organisation shall not be in breach of this Agreement if it does not
provide the services under this Agreement due to the following circumstances:
Industrial action by the Organisation’s employees
Industrial action by the staff of one of the Organisation’s suppliers
Fire, lighting, explosion, riot, civil commotion, malicious damage,
extreme weather conditions, storm, flood, burst pipes, earthquake, volcanic
eruptions, terrorism and the Hotel being damaged or destroyed.
Postal bookings which do not reach the Organisation
Breakdown of machinery, or any failure to supply the Hotel with gas,
electricity, water and so on, outside the control of the Organisation.
If any of the above
occurs the Organisation will do its best to avoid any inconvenience to you or you’re
The Organisation shall have the ability to assign, subcontract or
transfer any of its rights or obligations under the Agreement as it sees fit.
Third Party Rights
None of the terms of the Agreement are intended to be enforceable by any
third party nor is it intended that this Agreement will confer any right on any
person pursuant to the Contracts (Rights of Third Parties) Act 1999.
No variation of this Agreement shall be valid unless it is in writing
and signed by, or on behalf of, each of the parties.
Failure to exercise, or any delay in exercising, any right or remedy
provided under this Agreement by law to the Organisation shall not
constitute a waiver of that (or any other) right or remedy, nor shall it
preclude or restrict any further exercise of that (or any other) right or
If any provision of the Agreement (or part of any provision) is found by
a court to be invalid, illegal or unenforceable, that provision or
part-provision shall, to the extent required, be deemed not to form part of
this Agreement, and the validity and enforceability of the other provisions of
this Agreement shall not be affected.
Right of Set Off
The Organisation shall have the ability to deduct any sums owed to it by
the Guest against any sums it owes whether any such sum is present or
future (whensoever arising), liquidated or unliquidated, under this Agreement
or not. Any exercise by the Organisation of its rights under this clause
shall be without prejudice to any other rights or remedies available to it
under this Agreement or otherwise.
The Agreement shall be governed by the laws of England and Wales and the
Courts of England and Wales shall have exclusive jurisdiction to settle any
dispute or claim that arises out of or in connection with this Agreement or its
subject matter or formation
